Terms of use
These terms are written in plain English. By accessing CairnsJobs.au, creating an account, posting a job or submitting an application, you agree to these terms.
Who operates Cairns Jobs
Cairns Jobs is operated by SoDutch Pty Ltd, ABN 34 692 369 396.
Cairns Jobs is a local job board connecting employers and job seekers in Cairns and Far North Queensland.
We are not a recruitment agency, labour-hire provider or employer. We are not a party to any employment relationship created through the platform. We do not select candidates, conduct background checks or guarantee that an employer, applicant or employment opportunity will be suitable.
Job listings
Job listings must:
- relate to a genuine and currently available position
- be located in Cairns or Far North Queensland, unless we approve otherwise
- be posted by the hiring business or someone authorised to act for it
- accurately describe the role, employer, location and employment arrangement
- comply with applicable employment, workplace and anti-discrimination laws.
Listings must not:
- contain false or misleading information
- require applicants to pay an application, placement, equipment or registration fee
- promote pyramid schemes, multi-level marketing, investment schemes or similar opportunities
- disguise a business opportunity, sales scheme or unpaid position as ordinary employment
- include unlawful discriminatory requirements
- advertise unlawful pay rates or employment conditions
- collect applicant information for unrelated sales or marketing purposes.
Cairns Jobs may reject, edit, pause or remove a listing where reasonably necessary to enforce these terms, protect users, correct formatting, comply with the law or maintain the quality and security of the platform.
Initial listings may be reviewed by a person before publication. This review is a moderation process only and does not mean that Cairns Jobs has independently verified the employer, position, pay, safety or legitimacy of the opportunity.
Employers remain responsible for checking that their listings and recruitment practices comply with the Fair Work Act 2009, applicable awards, workplace laws and Queensland anti-discrimination laws.
Employer authority
By posting a listing, you confirm that:
- you are authorised to recruit for the position
- the information provided is accurate and not misleading
- you have permission to use any business name, logo, images or other material included in the listing
- you will respond to and manage applications lawfully and respectfully.
Listing content and promotion
You continue to own the content you submit.
You give Cairns Jobs a non-exclusive, worldwide and royalty-free licence to host, copy, format, resize, reproduce and display that content for the operation and promotion of Cairns Jobs and the advertised position.
This may include displaying or promoting the listing, employer name and employer logo through:
- CairnsJobs.au
- employer hiring-page widgets
- Facebook and Instagram
- the Cairns Jobs Facebook group
- email job alerts
- advertising and promotional materials.
This permission ends when the listing and associated promotional material are removed, except for reasonable archival, reporting or previously published social-media records.
Applications and applicant information
When a person applies through Cairns Jobs, the information they submit is provided to the employer responsible for that listing.
Employers must:
- use applicant information only for genuine recruitment purposes
- limit access to people involved in recruitment
- keep applicant information reasonably secure
- not add applicants to marketing databases without separate permission
- not sell or disclose applicant information for unrelated purposes
- securely delete or de-identify information when it is no longer reasonably required.
Cairns Jobs may suspend or permanently remove an employer that misuses applicant information.
Applicants are responsible for ensuring that the information they submit is accurate and for deciding what personal information to include. Applicants should not include unnecessary sensitive information in their application.
More information about how Cairns Jobs handles personal information is provided in our Privacy Policy.
Paid products
Standard job listings are free.
Cairns Jobs may offer optional paid products such as premium listings, featured placement, social-media promotion or other advertising upgrades.
Prices and the applicable promotional period will be shown before payment. Unless stated otherwise, prices are in Australian dollars and include GST.
Paid promotions begin and end according to the period shown at checkout. Change-of-mind refunds are not available after a promotion has started. Refunds or other remedies will still be provided where required by Australian Consumer Law.
Premium placement improves visibility but does not guarantee a particular number of views, applications, interviews or hires.
Founding Employer offer
The first 50 eligible local businesses approved as Founding Employers may receive three complimentary Premium Listing credits.
Unless otherwise stated:
- the offer is limited to one allocation per business
- businesses may be required to verify their identity, business details or connection to Cairns or Far North Queensland
- credits are not transferable, exchangeable or redeemable for cash
- credits cannot be combined with another promotional offer
- credits expire 12 months after being issued
- each credit may be used for one eligible Premium Listing
- unused credits are forfeited when they expire.
Cairns Jobs may refuse or cancel promotional credits where an account is duplicated, misleading, fraudulent or created primarily to obtain multiple offers.
Hiring-page widget and WordPress plugin
Businesses may display their active Cairns Jobs listings on their own website using our widget or WordPress plugin.
The standard widget is provided free of charge and must retain the visible Cairns Jobs attribution and link unless a separate written arrangement says otherwise.
Businesses must not:
- remove or conceal the attribution
- modify the widget in a way that misrepresents Cairns Jobs
- use it to display misleading or unauthorised information
- interfere with its security or operation.
We may update the widget or plugin from time to time. We may restrict or discontinue it where reasonably necessary and will provide reasonable notice where practical.
We do not guarantee that the widget will work with every website, theme, plugin, browser or hosting environment.
Accounts and acceptable use
Cairns Jobs may use passwordless sign-in links sent by email. You are responsible for keeping access to your email account secure and for notifying us if you believe your account has been accessed without permission.
You must not:
- scrape or copy the platform at scale without written permission
- attempt to bypass listing review or security measures
- create misleading, duplicate or fraudulent accounts
- upload malicious code
- interfere with the platform or another user
- use information from the platform for spam or unsolicited marketing.
We may restrict or suspend an account where we reasonably believe these terms have been breached or where action is needed to protect Cairns Jobs or its users.
Safety and reporting
Job seekers should conduct their own checks before attending interviews, providing identification, accepting employment or transferring money.
Never send money, banking passwords or account login details to an employer or recruiter.
Suspicious listings, privacy concerns and takedown requests can be reported to seo@sodutch.com.au.
We may investigate reports, request further information and remove content while a matter is reviewed.
Availability and liability
We take reasonable care in operating Cairns Jobs, but we do not guarantee that:
- every listing or applicant is accurate or genuine
- an employer will receive suitable applicants
- an applicant will receive an interview or job offer
- the platform, widget or plugin will always be available or error-free
- content submitted by users is complete, accurate or current.
To the extent permitted by law, Cairns Jobs is not responsible for employment decisions, workplace conduct, communications, agreements, losses or disputes between employers, applicants and other users.
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under Australian Consumer Law or another applicable law.
Where the law permits liability to be limited, our liability for a failure relating to a paid service may be limited to supplying the service again or paying the reasonable cost of having the service supplied again.
Changes to these terms
We may update these terms where reasonably necessary to reflect changes to the platform, our services or applicable law.
The updated date will be displayed at the top of this page. Where a change materially affects paid services or existing users, we will take reasonable steps to provide notice.
Continued use of Cairns Jobs after updated terms take effect means you accept the updated terms.
General
If part of these terms is found to be invalid or unenforceable, the remaining terms continue to apply.
A delay in enforcing a right under these terms does not mean that right has been waived.
These terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction over disputes concerning these terms.
